TERMS AND CONDITIONS

Please read the Terms and Conditions below before booking a tour with Chile Dream Tours:

(1) Our Contract: All bookings are made with Chile Dream Tours (CDT).  Upon booking a tour with CDT you have agreed to these Terms and Conditions, which is the full agreement between you and CDT.

(2) Private Tours: All bookings are private tours.  This means that you will have your own tour vehicle and guide.  It is possible that there will be other people, however, joining you at the different sites (i.e., wine tastings and adventure activities), which is beyond our control.  Please note that smoking and drinking alcoholic beverages in the tour van is strictly prohibited.

(3) Payments:  After you send us your reservation form, we will send you an online invoice from PayPal, which provides payment instructions.  All payments through Paypal must be made in United States Dollars (USD).  A 5% booking fee will be applied to all purchases.  Alternative payment options are available for Chileans and foreign residents of Chile.  Bookings are considered confirmed upon receipt of full payment.

(4) Cancellation Policy:

(a) Private Day Tours / Pre- and Post-Cruise Private Tours / Private Cruise Shore Excursions / Transfers: A full refund of the tour price – less the Paypal transaction fee (5%) – will be issued if cancelled 24 hours or more prior to the pick up time of your tour. In case of cancellation less than 24 hours before the scheduled pick up and/or in case of no-show, no refunds will be issued.

(i) Private Cruise Shore Excursion in Puerto Montt:

(A) In the event a cruise ship is unable to disembark passengers in Puerto Montt on the tour date due to weather conditions, a refund will be issued less the Paypal transaction fee and a USD 200 cancellation fee.  The refund will be issued within 24 hours of notification of the tour cancellation. 

(b) Explore Chile Multi-Day Private Tours / Custom Group Tours:  A refund will be issued – less the Paypal transaction fee (5%) – and a USD 200 cancellation fee if cancelled 60 days or more prior to the date of your tour.  A 50% refund of the tour price will be issued – less the Paypal transaction fee (5%) –  if cancelled between 30 and 60 days prior to the date of your tour.  In case of cancellation less than 30 days before the scheduled tour date and/or in case of no-show, no refunds will be issued.   This applies to The Highlights of Patagonia Private Tour, Carretera Austral “Southern Highway” Patagonia Private Tour, Land of Volcanos: Lakes Region and Chiloe Island Private Tour, La Serena and Elqui Valley Road-Trip Private Tour, The Highlights of the Atacama Private Tour, Discover Chile Dream Tour, and any custom group tours.  

(i) The Highlights of Patagonia Private Tour:

(A) Summer Season (November 1 – March 31)

(1) In the event of the cancellation of the boat tour to Balmaceda and Serrano Glaciers due to poor weather conditions, we will substitute this activity with a visit to Fort Bulnes and the Strait of Magellan Park near Punta Arenas.

(2) In the event of the cancellation of the boat tour to Magdalena Island Penguin Colony due to poor weather conditions, we will substitute this activity with a visit to Fort Bulnes and the Strait of Magellan Park near Punta Arenas.

(3) In the event both the sailing to Balmaceda and Serrano Glaciers and the sailing to Magdalena Island Penguin Colony are cancelled due to poor weather conditions, we will substitute one sailing with a visit to Fort Bulnes and the Strait of Magellan Park near Punta Arenas and will issue a reimbursement of USD 250 per person for the other sailing.  The reimbursement will be issued within 24 hours of notification of the cancellation of the sailing. 

(B) Winter Season (April 1 – October 31)

(1) In the event of the cancellation of the boat tour to Balmaceda and Serrano Glaciers due to poor weather conditions, a reimbursement of USD 180 per person will be issued. The reimbursement will be issued within 24 hours of notification of the cancellation of the sailing.

(ii) Carretera Austral “Southern Highway” Patagonia Private Tour:

(A) In the event the sailing to the Marble Caves is cancelled due to poor weather conditions, a reimbursement USD 150 per group will be issued.  The reimbursement will be issued within 24 hours of notification of the cancellation of the sailing.

(B) In the event the sailing to Laguna San Rafael is cancelled due to poor weather conditions, a reimbursement of USD 180 per person will be issued. The reimbursement will be issued within 24 hours of notification of the cancellation of the sailing.

(5) Force Majeure: Should situations arise beyond our control, such as strikes, demonstrations, epidemics, earthquakes, etc., CDT has the right to end or modify the tour.  No refunds will be issued if the tour has already been initiated or within the cancellation policy time frames explained above.  Please understand that the nature of certain tours requires considerable flexibility and you should allow for alternative itineraries. The itinerary provided for each tour is representative of the types of activities contemplated, but it is understood that the itineraries, route, schedules, sightseeing, activities, and mode of transport may be subject to alteration without prior notice due to local circumstances or events beyond our control, including weather, road closures, and strikes.

(6) Insurance: It is recommended that guests arrange their own personal travel insurance for their trip, covering accidents, medical costs, repatriation costs and loss of or damage to property, and tours.  CDT is not responsible for items left in the tour van during the tour.

(7) Limitation of Liability:

(a) CDT is excluded from all liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a tour.

(b) The client releases CDT and its employees, agents and representatives from any liability and expressly waives any claims he or she may have against CDT arising out of or in connection with his or her participation in a tour.

(c) CDT contracts with a network of companies and individuals to assist in the running of our tours as third-party agents. We are not responsible for the acts and omissions of these third parties.

(8) Photos and Marketing: You give CDT your consent to use images of you taken during the tour for advertising and promotional purposes in any medium we choose.  If you would not like pictures taken of you during a tour, simply inform your guide.

(9) Gift Cards: Gift Cards are redeemable only for tours booked online directly with CDT at www.chiledreamtours.com, based on availability.  A 5% processing fee is applied to all Gift Card purchases.  Payment must be made in United States Dollars (USD).  Gift Cards are non-transferable and cannot be exchanged for cash by either the purchaser or the recipient(s).  Gift Cards are valid for one year after the date of issuance.  The Gift Card is considered used once it is redeemed by the recipient(s) in booking a tour.  All other cancellation policies apply.  The purchaser may request a refund (less the processing fee) if the Gift Card has not been redeemed by the recipient(s), however, the refund must be requested within one year of the date of issuance.  For Monetary Gift Cards, the amount must be in United States Dollars (USD).  If there is an amount left over after the Gift Card recipient has purchased a tour, CDT will issue a credit to the recipient to be used towards the purchase of a future tour, valid for another one-year period.  For both Monetary Gift Cards and Tour Gift Cards, there is a minimum of 2 guests required per tour.
